Abstract
This Act, consisting of 10 articles, provides for defining the legal framework to implement and enforce the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilisation to the Convention on Biological Diversity. Therefore, the Act indicates the applicable Regulation of the European Union and prescribes that is prohibited to act in violation of the mentioned EU Regulation. The Act defines Ministerial powers to designate a national contact point for access and benefit-sharing, and to take immediate temporary measures for the preservation of genetic resources or products developed from them, including: prohibiting anyone from transporting, treating, processing or marketing of genetic resources; ban on further use of genetic resources and related products; obligation to temporarily store genetic resources and related products; obligation to identify and register genetic resources; obligation to return to the country that provided the genetic resources; obligation to immediately inform holders of genetic resources in case the resources or their related products have been acquired without respecting the provisions of this Act.
