Abstract
This Regulation, divided into eleven chapters and consisting of 103 articles, contains rules and provisions for implementing the Fertilisers Act, and concerns use and trade of fertilisers and of animal feed, having regard to the provisions of the soil protection Act and of the Decree implementing provisions of the fertilising substances Act. The Regulation defines the following terms: sampling and packaging equipment; business location; animal unit; laboratories for analysing nitrogen and phosphate in animal manure; eutrophication, as the enrichment of the water by nitrogen and phosphate compounds, which leads to accelerated growth of algae and higher plant life forms, resulting in an undesirable disturbance of the balance between the various organisms present in the water and a deterioration of water quality; manure granules; solid manure; transport ticket for sewage sludge and compost; liquid sewage sludge; grazing animals; land where forestry is practiced.
Matters covered by this Regulation include: trading of fertilisers; list of organic waste and residues that can be traded as fertilisers; treatment of phosphates recovered from sewage sludge; use of other inorganic fertilisers containing organic matter of animal or vegetal origin; admitted levels of nitrogens and phosphates in fertilisers; amount of heavy metals, and organic micro-pollutants in fertilisers, and measures to protect the environment; application standards for animal fertilisers; application for and issuance of permits for using animal fertilisers; farmers’ rights in the use of fertilisers; use of fertilisers for agricultural land improvement; drawing up and revision of a fertilisation Plan; amount of nitrogen and variety of crops cultivated, including: barley, potatoes, sugar beets, wheat; compensation related to the use of phosphates; environmental effects regarding the production, sales and use of mineral concentrate; storage capacity of animal fertilisers; administrative obligations for farmers; obligations of intermediaries, suppliers and customers; registration of means of transport; inspection by the competent authority.
Concerning transport measures, the Regulation specifies: special equipment for the transport of animal fertilisers; notification and registration for identification; sampling during the transport; manure processing; classification of farmers based on the use and production of fertilisers; manure production and quantity determination. Further topics covered by the Regulation include: definitions of raw milk, farm milk and delivery of farm milk; average milk production per dairy cow; milk control station; analysis of manure samples by the authorised laboratories; content of nitrogen in animal feed; quality of the soil; transfer of production rights and relocation of a pig, chicken or turkey farm within a company.
