Abstract
The present Act regulates the working conditions and working environment in the shipping sector. The Act applies to employees that work on board in Norwegian vessels, and should be read in conjunction with the Working Environment Act and the Ship safety Act. The Act contains the following Chapters: 1) Introductory provisions; 2) Duties of the employer and the shipping company, etc.; 3) Employment, etc.; 4) Salary, etc.; 5) Termination of employment; 5 a) Employee's rights in the event of a business transfer; 6) Disputes concerning working conditions; 7) Right to leave; 8) The shipping company's and shipmaster's duties of care; 9) The ship service; 10) Protection against discrimination; 11) Information and discussion; 12) Supervision and sanctions; 13) Other provisions.
It shall be the employers responsibility to ensure that the provisions of this Act and the employment contract are complied with, except when this responsibility shall fall on the shipping company.
