Abstract
The purpose of this Act is to contribute to the efficient use of society's resources and safeguard the interests of consumers by promoting honesty, predictability and loyalty in contractual relationships between businesses in the food retail industry. The Act consists of 21 Sections divided into the following Chapters: 1. Introductory provisions; 2. Good commercial practices; 3. Supervision, enforcement and review; 4. Final provisions.
The Act applies to negotiations and agreements concerning the delivery of groceries: a) which are intended for resale to consumers though outlets that have the sale of groceries as an essential part of their business; or b) for sale to an institutional household through a party who also delivers groceries to outlets mentioned in letter a. It does not apply to consumer sales, or to negotiations and agreements between primary producers and industrial actors.
In business relationships between business owners in the food retail industry, no actions contrary to good commercial practices shall be taken. Good business practices must be based on honesty, predictability and loyalty. Different rules are included regarding information exchange, protection of the parties' investments, registration and clarity of deeds, etc. The Act creates the Food Retail Authority, which will be responsible for supervising the provisions of this Act.
