Abstract
This Act regulates consumer purchases or sales, which is defined as the sale of goods to a consumer when the seller or seller's representative is engaged in a commercial enterprise. The Act applies to: a) the ordering of goods that must be manufactured; b) the supply of water; c) the purchase of receivables or entitlements; and d) agreements with a power grid company for the supply of electrical energy.
It contains the following Chapters: 1. Introductory provisions; 2. Delivery, etc.; 3. Risks relating to the item; 4. The item's properties, defects, etc.; 5. Delays. The consumer's right as a result of late delivery; 6. The consumer's rights with respect to defective goods; 7. The consumer's obligations; 8. Cancellation and return; 9. The seller's rights in the event of breach of contract by the consumer; 10. Mutually applicable rules on cancellation and redelivery; 11. Mutually applicable rules relating to compensation; 12. Miscellaneous provisions; 13. Entry into force and amendments to other legislation.
According to Section 3, terms and conditions less favourable to the consumer than those stemming from the provisions of this Act may not be agreed on. The parties are otherwise free to agree what they want within the framework of the Act.
