Abstract
This Decree makes provision for the procedures of application for plant breeders' rights and their registration and publication and related matters. Plant breeders' rights can be assigned in accordance with the Act not only to persons who are citizens or have their residence or seat in UPOV member countries but also to persons who are citizens or have their residence or seat in countries which are member of the World Trade Organization. Under certain circumstances the Plant Varieties Board may assign rights to persons other than those indicated above (sects. 2). Such rights can be assigned for plant species of all botanical varieties and families including hybrid varieties. Applications shall be made to the Plant Varieties Board (sect. 5). Section 8 concerns publication of applications and specifies the contents of such notice. Sections 14 and 15 make provision for the registration of rights in the Plant Varieties Register. The Plant Varieties Board shall consist of 7 members and its secretariat shall be administered by the State Agricultural Supervision Agency. (21 sections)
