Abstract
The text of this Regulation is divided into 8 Chapters: Preliminary (I); Provisions Relating to Irrigation and Water Distribution (2); Provisions Relating to Water Users Organization (3); Security, Repair and Maintenance Relating to Canal or Irrigation Structure (4); Provisions Relating to Water Charge (5); Provisions Relating to Realization (6); Provisions Relating to Licence (7); Miscellaneous (8).
The Government may appoint chief Irrigation Officer and other Officers for the purpose of construction, operation, maintenance, control and supervision of Canal or other irrigational structures for doing work related to irrigation. The Regulation sets out (a) the criteria to be followed by the Officer for a proper distribution and use of water, (e.g. the area of the land, the types of crops to be grown, the nature of the soil, the quantity of water available and the conditions of the Canal and other irrigational structure); (b) the circumstances under which the distribution of water should be stopped; (c) the duty of the Officer to keep a record of Water Users. Moreover, the Regulation establishes the formation, functions, duties and powers of Water Users Groups and Water Users Associations. In case there are more than three Water Users Associations within an Irrigation Area a Water Users coordination Committee shall be formed for the purpose of coordinate the different associations and advising on the distribution of water. Chapter 4 concerns activities that pollute water or cause damage to Canals or any other Irrigational Structures and therefore be prohibited by the Irrigation Officer. The Water User shall pay a water charge according to the criteria and procedure set out in Chapter 5. The use of water resources for irrigation or other agricultural purposes on an institutional basis by the Institution of Water Users is subject to the issuance of a licence, upon payment of an annual fee. The keeping of the Record Book of Licence is entrusted to the District Irrigation Office.
