Abstract
This Act provides for public health services in Nepal. It consists of nine chapters: 1. Preliminary; 2. Rights, Duties of Service Recipients and Responsibilities of Health Institutions; 3. Relating to Health System and Management of Service; 4. Blood, Use of Blood Based Substances and Human Organs Transplant; 5. Social, Cultural and Environmental Determinants for Protection, Promotion and Improvement of Public Health; 6. Emergency Health Service and Management; 7. National Public Health Committee; 8. Offences and Punishment; and 9. Miscellaneous.
Chapter 1 contains the short title and definitions. Chapter 2 provides citizens of Nepal, the right to obtain quality health service in an easy and convenient manner. The right to free basic health for various services are mentioned. The government is duty bound to provide quality health service to all citizens. The duties of citizens receiving health services and those of the health institutions are laid down. Chapter 3 makes provisions in respect of operation and regulation of health institutions, licensing for non-governmental or private health institutions, maintaining quality of service provided, human resources development, monitoring and inspections, pricing of medicines, setting up of health fund and emergency health fund. Chapter 4 provides for services relating to blood transmission and organ transplant.
Chapter 5 states that the government of Nepal may prescribe minimum quality standards for the manufacturing, storage, sale and distribution of the consumable goods including food, meat and water. Further, necessary standards are to be made for reducing effect of noise, air, water and environment pollution, and waste, on public health. It requires public health impact assessment to be conducted by the industries, businesses and projects before obtaining approval. Safety measures must be adopted for health of workers in the risk zone. Risk zone means a workplace with any chemical, biological, climate change based, psycho-social, corporal, physical and geographic condition adversely affecting the human health.
Chapter 6 provides for emergency health services and management. It requires a list of infectious diseases to be prescribed by the Government of Nepal. Chapter 7 establishes a National Public Health Committee for making policy recommendations in respect of public health. The composition, functions, duties and powers of the committee are laid down. Chapter 8 contains the offences and penalties. Chapter 9 requires health institutions to maintain records of service recipients and submit reports of services provided to the licensing authority.
