Abstract
This Act provides for regulation of public private partnership and investments in infrastructure sector and service sectors in Nepal. The term infrastructure is defined to include road, tunnel way, bridge, canal, reservoir, sewerage, cable car, railways, tramway, metro rail, mono rail, sky rail, trolley bus, bus rapid transit, dry port, waterway stoppage, airport, hospital, cold storage, warehouse, public city hall, stadium, hydro power, renewable energy generation such as biological, wind, solar, or atomic thermal and geo-thermal energy generation, transmission and distribution, exhibition hall, amusement park, solid waste processing and management plant, communication and information technology infrastructure, financial market infrastructure, special economic zone, export promotion and processing, special industrial zone, and tourism sector.
Chapter 2 contains provisions relating to approvals for investments in Nepal and implementation of public private partnership projects. It provides for formation of an Investment Board and the functions, duties and powers of the Investment Board are laid down. A Monitoring and Facilitation Committee is established for implementation, monitoring and facilitation of projects. Further, a Public Private Partnership Unit and an Investment Unit are created. Chapter 3 lays down the methods to implement public private partnership projects. The procedure for identifying and approving projects is laid down. Chapter 4 makes provisions relating to private investment projects. Chapter 5 provides for the contractual arrangements and chapter 6 contains provisions relating to facilities and incentives. Chapter 7 establishes a one stop service centre for cooperation and facilitation of projects. Chapter 8 provides for the fund of the Board, compensation for any act in contravention to the law or agreement, settlement of disputes and power of the Board to frame regulations to achieve the objectives of the Act.
