Abstract
This Act lays down rules for the protection and development of coastal fisheries waters of the Republic; the sustainability of coastal fisheries waters and aquaculture management and development; protection of livelihood and food security; management, development and utilization of fishery resources taking into consideration traditional knowledge, best available scientific information and in accordance with best management practices; community participation in coastal fisheries and aquaculture management; and the cooperation between the Government and the community to ensure compliance with conservation and management measures for coastal fisheries waters and aquaculture. This Act shall apply to (a) all coastal fisheries waters and areas over which Nauru exercises jurisdiction or sovereign rights; (b) fisheries resources and related habitats in coastal fisheries waters; (c) coastal fisheries; (d) aquaculture and related activities; (e) persons, vessels, vehicles, aircraft, export facilities or other vessels or place engaged in or otherwise connected with any activity falling within the scope of this Act; and (f) persons and vessels in coastal fisheries waters. This Act sets forth provisions on the establishment, duties and structure of Coastal Fisheries Advisory Council; the establishment, structure and objectives of Community Fisheries Stakeholder Forum; declaration of an area as a designated fisheries management area; preparation and content of a National Coastal Fisheries Management Plan and National Aquaculture Plan; determination of allowable catch in coastal fisheries waters; declaration of closed seasons; delineation of community fisheries management areas; registration of a community fisheries management committee; development, monitoring and evaluation of community fisheries management area plans; registration of aquaculture operators; aquaculture standards with regard to internationally agreed standards and codes of practice; collection of data on coastal fisheries and aquaculture; appointment and powers of the authorized officers; establishment of a Coastal Fisheries and Aquaculture Development Fund; liabilities; offences and penalties.
