Abstract
The Environmental Management and Climate Change (Littering Fixed Penalty Offences) Regulations 2025 implement the Environmental Management and Climate Change Act 2020 by establishing a fixed-penalty regime for littering offences in public places. The Regulations prescribe offences and penalties relating to litter control, waste management responsibilities of business premises, and liability of vehicle drivers for littering, with the objective of deterring unlawful waste disposal, promoting responsible waste management practices, and reducing adverse impacts on public health. They set out procedures for the issuance, payment, and enforcement of fixed penalty notices, including court proceedings for non-payment, evidentiary requirements, and administrative responsibilities of authorised officers, police, the Nauru Revenue Office, and the courts. The Regulations further provide for court-imposed sanctions, recovery of costs, and measures to deprive offenders of benefits derived from offences.
