Abstract
The Regulations establish the administrative, procedural, and compliance framework governing the Republic of Nauru’s sponsorship of seabed mineral exploration and exploitation applications to the International Seabed Authority under the Nauru Seabed Minerals Authority Act 2024. They define the powers and responsibilities of the Authority, set application requirements and timelines, and regulate consultation between the Authority, the International Seabed Authority (ISA), and Sponsored Parties in accordance with United Nations Convention on the Law of the Sea and ISA rules. The Regulations require detailed submissions covering environmental impacts, governance, financing, management systems, and operational plans, alongside expert review and public consultation processes. They also provide for Sponsorship Agreements with conditions relating to monitoring, insurance, performance, and security deposits, while imposing obligations for reporting, recordkeeping, compliance statements, and real-time operational data sharing. Enforcement mechanisms include compliance and emergency directions, penalties, inquiries, whistleblower protections, dispute resolution through UNCITRAL arbitration, and controls on assignment or changes in ownership.
