Abstract
The Ports and Navigation Act 2019 of Nauru is a comprehensive legal framework enacted to regulate ports and maritime navigation within the country, with the primary objectives of ensuring safety, security, and efficiency in port operations, protecting persons, property, and the environment, and fulfilling Nauru’s obligations under international maritime conventions. The Act establishes the Nauru Maritime and Port Authority, outlining its governance, functions, and powers, including the administration of charges, property management, and enforcement of maritime safety and environmental protection standards. It also covers various aspects such as navigation rules, pilotage, assistance at sea, cargo handling, dangerous goods management, port state control, and liability limitations for maritime claims, reflecting adherence to international conventions like nternational Convention for the Safety of Life at Sea (SOLAS), and the International Convention for the Prevention of Pollution from Ships (MARPOL).
Furthermore, the Act addresses environmental protection through regulations on ballast water management, pollution control, anti-fouling systems, and wreck and salvage operations, ensuring sustainable maritime practices. It also includes provisions for investigation and prosecution of maritime accidents and offences, emphasizing accountability and compliance. The legislation incorporates transitional arrangements and amendments to maintain consistency with evolving maritime laws and international agreements. The text consists of 228 Articles divided into 11 Parts and has one Schedule.
