Abstract
The Trademarks Act 2019 of Nauru establishes a comprehensive legal framework for the registration, protection, and enforcement of trademarks. It sets out the roles and responsibilities of the Registrar of Trademarks, the application and opposition procedures, and the conditions under which a trademark may or may not be registered. The Act defines a wide range of marks that can be protected, including signs, slogans, colors, sounds, and holograms, and grants exclusive rights to owners, including the ability to assign, license, or take legal action against infringement. It also provides for the duration (10 years), renewal, alteration, surrender, and rectification of registered trademarks, and includes specific provisions for collective trademarks used by associations.
The text consists of 67 Articles divided into 12 Parts. The accompanying Trademarks (Forms and Fees) Regulations 2020 specify the necessary forms and fees for all trademark-related applications and processes.
