Abstract
These Regulations relate to domestic fishing within the territorial waters of Niue and consist of 12 Regulations: i.e. Title and Commencement (1), Interpretation (2); Prohibited fish exports (3); Fish size limit (4); Fish quota limits (5); Destructive organisms (6); Protected fish species (7); Vessel safety equipment (8); Annual license fee for vessels (9); Vessels fishing inside Niue's territorial sea zone (10); Vessels fishing outside Niue's territorial sea zone (11) and Measurement of crustaceans size limit (12).
Regulation 3 lists a series of prohibited fish exports including turtles, dolphins, live tropical fish and crayfish and also states the export of the Uga (Birgus larro) in any form from 1 December to 28 February without Cabinet's written approval to be prohibited. Regulation 4 specifies the fish size limit, no person may be in possession of more than 10 clams or crayfish a day unless a Quota license has been obtained by the Director and approved by Cabinet (Reg. 5). Regulation 6 lists the organisms that may be removed and destroyed that are deemed harmful to Niue's reefs. Regulation 8 specifies the equipment required aboard vessels including two-way communication radio and a spare outboard motor.
All fishing vessels within Niue territorial waters are subject to the requirements of the Domestic Fishing Act 1995 and Cabinet may impose any additional vessel requirements, fishing quotas and size limits it deems necessary (Reg. 10). Fishing vessels operating outside Niue's territorial sea zone must comply with the Territorial Sea and Exclusive Economic Zone Act 1996 (Reg. 11). Crustaceans under 36 mm. should not be hunted as they represent the breeding stock of the fish population (Reg. 12).
Entry into force notes
These Regulations commenced on the 5 March 1996, except for section 8(2), (3) and (4) that commenced on 1 August 1996.
