Water Regulations 2017 (No. 01/2017).

These Regulations, made by the Cabinet under sections 11, and 66 of the Water Act 2012, make provision with respect to selected matters regarding water resources in Niue such as water abstraction and water pollution as provided for by the Act. Application for construction, alteration, or maintenance of a bore shall contain the information specified in Schedule 1. The Regulations prescribe, in the Schedules, the information that an application for the construction, alteration, or maintenance of a bore, for an extraction licence, or for a water pollution control licence must contain. An extraction licence must be in a form provided by the Public Works Director and contain the information specified in Schedule 3. It is a condition of every extraction licence that the holder's activities are carried out in such a manner that will minimise the pollution o£ water resources and the wastage of water and the Director of Public Works may impose additional conditions. Applications shall be accompanied by a fee. The applicant must pay all the reasonable costs of the Public Works Director in relation to the application, including the costs of providing a connection to the main public water supply and providing and connecting any water meter.
