Abstract
This Act regulates the registration, sale and quality control of fertilizers. It is divided into 26 sections and 1 schedule. Section 3 prohibits the sale of: (a) fertilizers which are not registered; (b) fertilizers containing more than the prescribed portion of a restricted component; and (c) registered fertilizers not labelled in the prescribed manner. Manufacturers or importers of fertilizers may apply for the registration of fertilizer components and brand names against payment of a fee (sect. 4). This section does not apply to animal manure or other animal or vegetable matter. Sections 5 and 6 deal with grounds for rejection of applications and revocation of registration respectively. The Director-General shall give written notice to the proprietor who has the right to appeal within 28 days from the date of the decision (sects. 7 and 8). The provisions on quality control are based on adherence to a prescribed programme of chemical and physical analysis of additives and fertilizers. Section 14 deals with powers of inspectors who must use registered laboratories. The remaining sections deal with analysis (DG approves specific methods), data-collection and information, offences and penalties, regulations and consequential amendments.
