Abstract
An Act to provide for fishing on the high seas and to make extensive amendments to the 1996 Act. The provisions here amended provide, inter alia, for: the definition of "fish stock agreements" (sect. 2); allocation of quotas (sects. 52 and 53); fishing licences and fishing to be authorized by fishing permit (sects. 83 and 89); the High Seas Permit Register (sect. 98); registration of fishing vessels and fish carriers (sects. 103 and 105); all fishing within foreign fishing jurisdiction to be authorized (sect. 103A). Presumption that fish on registered vessel caught in New Zealand (sect. 109). A new part on high seas fishing (6A) is inserted laying down requirements as to taking of fish on high seas, providing for the issue of high seas fishing licences, and regulating inspection by high seas fishing inspectors. The High Seas Permit Register must contain all the particulars required by regulations made under section 297.
New Schedule: Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks. Schedule 6 is amended.

The bulk of provisions of this Act come into force on a date to be appointed by the Governor-General by Order in Council; and one or more Orders in Council may be made appointing different dates for different provisions and for different purposes.
Notes
This Act replaces all previous Fisheries Acts and amendment Acts. Regulations made under the Fisheries Act 1983 are still in force and deemed to have been issued under the present Act. However, only parts of the Fisheries Act 1996 are as yet in force; large amounts of the Fisheries Act 1983 and the Fisheries Amendment Act 1986 are also still in force.
