Abstract
The Hawke’s Bay Agricultural and Pastoral Society Empowering Act 2023 enables the Society to sell its interests in the Tomoana Showgrounds and any other land it may acquire without the obligation to reinvest the proceeds into purchasing other suitable land. This legislative change is significant as it removes previous restrictions imposed by the Agricultural and Pastoral Societies Act 1908, allowing the Society greater flexibility in managing its assets. The Act outlines specific conditions under which the Society can sell its land. These include the necessity for the sale to be advantageous to the Society, a resolution by at least two-thirds of the members present at a general meeting, and a minimum of 14 days' notice given to members regarding the meeting and the proposal to sell the land. Furthermore, the Act mandates that any money received from the sale must be applied towards purposes consistent with the Society's objectives, ensuring that the funds are used to further the Society's mission rather than for unrelated activities.
