Abstract
The purpose of this Act is to promote balance between work and other aspects of employees’ lives and, to that end, to provide employees with minimum entitlements to a)annual holidays to provide the opportunity for rest and recreation; (b) public holidays for the observance of days of national, religious, or cultural significance; (c) sick leave to assist employees who are unable to attend work because they are sick or injured, or because someone who depends on the employee for care is sick or injured; (d) bereavement leave to assist employees who are unable to attend work because they have suffered a bereavement; (e) family violence leave to assist employees to deal with the effects on the employees of being people affected by family violence.
Part 1 deals deals with preliminary matters, including the definition of key terms, the application of the Act, the relationship between the Act and employment agreements. Part 2 confers minimum entitlements to annual holidays, public holidays, sick leave, bereavement leave, and family violence leave; contains provisions dealing with how holiday pay and leave pay is calculated in various circumstances and when it must be paid. Part 3 deals with the enforcement of an employee’s entitlements and other matters, including who can enforce entitlements in addition to the employee, the penalties for non-compliance with the Act, the requirement of an employer to keep a holiday and leave record, the presumption of continuous employment in certain circumstances.
Entry into force notes
Subpart 2 of Part 2 and Schedule 1 come into force on 1 April 2007. The rest of this Act comes into force on 1 April 2004.
