Abstract
This Act, consisting of 314 sections divided into twelve Parts and completed by twenty Schedules, The purpose of this Act is to provide for democratic and effective local government that recognises the diversity of New Zealand communities; and, to that end, this Act: a) states the purpose of local government; b) provides a framework and powers for local authorities to decide which activities they undertake and the manner in which they will undertake them; c) promotes the accountability of local authorities to their communities; and d) provides for local authorities to play a broad role in meeting the current and future needs of their communities for good-quality local infrastructure, local public services, and performance of regulatory functions. Amendments deal also with requirements imposed by the Local Government Act 2002, while the Epidemic Preparedness (COVID-19) Notice 2020.
The Act is divided as follows: Preliminary provisions (Part 1); Purpose of local government, and role and powers of local authorities (Part 2): Structure and reorganisation of local government (Part 3): Governance and management of local authorities and community boards (Part 4): Council-controlled organisations and council organisations (Part 5); Planning, decision-making, and accountability (Part 6); Specific obligations and restrictions on local authorities and other persons (Part 7); Regulatory, enforcement, and coercive powers of local authorities (Part 8); Offences, penalties, infringement offences, and legal proceedings (Part 9); Powers of Minister to act in relation to local authorities (Part 10); Regulations, other Orders in Council, and rules (Part 11): Consequential amendments, repeals, revocations, transitional provisions, and savings (Part 12).
