Abstract
The Local Government (Water Services Preliminary Arrangements) Act 2024 establishes a framework for local governments in New Zealand to manage and deliver water services. The Act requires territorial authorities to prepare water services delivery plans that outline the current state of their water services, demonstrate their commitment to meeting regulatory standards, and ensure financial sustainability. The Act also provides for ministerial intervention if authorities struggle to prepare these plans and mandates public disclosure of foundational information to support economic regulation. The Act includes provisions for joint arrangements between territorial authorities and specific requirements for Watercare Services Limited to be financially separate from Auckland Council. It sets out consultation and decision-making processes for establishing or amending water services council-controlled organizations and joint local government arrangements. Additionally, the Act introduces a Crown monitor to oversee Watercare's compliance with a Watercare charter, which includes service quality standards, financial performance objectives, and a price-quality path. The Act aims to promote the long-term benefit of water service consumers, ensure efficient management of water services, and maintain the integrity of water infrastructure. It also includes provisions for information disclosure, monitoring, and enforcement to ensure compliance with the established framework.
