Abstract
The purposes of this Act, consisting of 6 Parts and nine Schedules, are to: (a) implement the agreements made in the Deed of Settlement dated 23 September 1992; and (b) provide for the development of the collective and individual interests of iwi in fisheries, fishing, and fisheries-related activities in a manner that is ultimately for the benefit of all Maori. To achieve the purposes of this Act, provision is made to establish a framework for the allocation and management of settlement assets through: (a) the allocation and transfer of specified settlement assets to iwi as provided for by or under this Act; and (b) the central management of the remainder of those settlement assets.
The Act sets out provisions for the classification of deepwater and inshore quota, the determination of iwi coastline entitlements, and for the reorganization of joint mandated iwi organizations. The text provides for the establishment of new entities specifying their powers and duties. The entities shall include: the Te Ohu Kai Moana Trustee Limited, the Aotearoa Fisheries Limited, the Te Putea Whakatupu Trustee Limited, Te Wai Maori Trustee Limited. Other provisions of the Act include: settlement quota interests; sales and exchanges of settlement quota; related restrictions; resolution of disputes. In Schedule 9 of the Act various Acts have been amended.
