Abstract
The purpose of this Act is to a) provide clear powers for the enforcement of New Zealand’s criminal law in international waters; and b) uphold New Zealand’s rights and obligations under international law, particularly the United Nations Convention on the Law of the Sea, consistent with international human rights law. Part 2 disciplines powers, and establishes: the list of powers recognised to the enforcement officer, the geographical application (this Act applies to any ship that is in international waters or foreign waters); restriction on the exercise of powers in relation to foreign ship and other restrictions; and the grounds for exercising powers. Powers include stopping, boarding, searching detention of ship, etc. Part 3 concerns offences and immunities.
