Abstract
This amendment Act inserts a new Part IIIA entitled "Protection of certain confidential information about innovative pesticides". The Pesticides Board is to protect such information when it receives an innovative pesticide application for a period known as the "protected period". The latter is defined in section 2 as beginning on the date of receipt of the application and ending (i) when the Board has either issued or refused to issue a certificate of registration and the date of that issue or refusal is not more than 5 years after the date of receipt of the application, on the date 5 years after the date of issue or refusal; (ii) in any other case, on the date 5 years after the innovative pesticide application to which that information relates was received. In cases where applications were received not more than 15 years prior to the commencement of this Act, relative provisions apply. These provisions apply to information about agricultural chemicals as well.
