Abstract
Part I of the Act defines the territorial sea of New Zealand.
Part II, in which the exclusive economic zone of New Zealand is defined, also contains provisions concerning: total allowable catch (sects. 11-13); foreign fishing (sects. 12-14); grant, renewal and variation of fishing licences (sects. 15-17); fees (sect. 18); offences (sect. 19); non-commercial fishing (sect. 23); enforcement and related matters (sects. 24-25); fisheries regulation (sect. 22) and regulations in general (sect. 27).
Part III contains miscellaneous provisions. The territorial sea of New Zealand has as its inner limits the baselines described in sections 5 and 6 and as outer limit a line which is distant 12 nautical miles from the baselines (sect. 3). The baseline shall be in general, and subject to section 6, the low-water mark along the coast of New Zealand, including the coast of all islands (sect. 5). Section 6 provides for baselines adjacent to bays. The EEZ shall extend seawards to 200 nautical miles measured from the baselines. Sections 10 to 28 regulate in detail the fishing by foreign vessels in the EEZ, and in particular provide for total allowable catch, grant of licences, apportionment of total allowable catch, regulation-making powers of the Minister, enforcement, and offences. An Act to make provision with respect to the territorial sea of New Zealand; and to establish an exclusive economic zone of New Zealand adjacent to the territorial sea, and in the exercise of the sovereign rights of New Zealand to make provision for the exploration and exploitation, and conservation and management, of the resources of the zone; and for matters connected with those purposes.
