Abstract
These Regulations, comprising 76 articles, establish a comprehensive regulatory framework under which the Ministry of Heritage and Tourism is required to maintain official registers of tourism activities and licensing records, accessible to interested parties. They further require any person or entity engaging in tourism activities or operating tourism establishments to obtain a prior licence from the Ministry before commencing operations.
The Regulations address the following (i) General Licensing Framework (Articles 1–15), establishing the overall licensing system for tourism activities. They define the 6 categories of tourism licenses, and set procedures for application, approval, renewal, and validity; (ii) Tourism and Hotel Establishments (Articles 16–30), regulating the establishment, classification, and operation of tourism and hotel facilities. They set requirements for preliminary project approvals, land-use compatibility, and classification standards, while imposing operational obligations. They also classify certain restaurants and cafés as tourism establishments and establish the mandatory collection and remittance of tourism fees and staff service charges; (iii) Travel and Tourism Offices and Foreign Branches (Articles 31–35), governing the activities of travel and tourism offices and foreign tourism companies operating. They define the services that licensed offices may provide, require the use of licensed tour guides, mandate travel insurance for organized tour packages; (iv) Tour Guiding (Articles 36–40), regulating the licensing and professional conduct of tour guides, including eligibility requirements, classification into general, local, and specialized categories, and group size limits. They also prohibit guides from engaging in certain activities, including discussing political or religious matters with tourists or guiding in restricted security areas without authorization; (v) Adventure Tourism (Articles 41–44), establishing the regulatory framework for adventure tourism activities, including licensing and safety certifications, insurance coverage, specialized guides, and safety briefings to participants; (vi) Fine Arts Performing Groups (Articles 45–50), regulating entertainment performances within tourism establishments, prohibiting performances during specified religious occasions, requiring compliance with public morality standards, and prohibiting political or religious themes; (vii) Business Tourism (Articles 51–54), including conferences, exhibitions, and corporate incentive travel; (viii) Usufruct and Exploitation of Tourism Sites and Government Land (Articles 55–69), regulating the use and development of government-owned tourism land and protected tourism sites. They assign the Ministry responsibility for safeguarding tourism resources, establish procedures for leasing and usufruct agreements, require registration of contracts and financial guarantees, restrict the transfer of usufruct rights without prior approval; (ix) Inspection and Administrative Sanctions (Articles 70–76), establishing the Ministry's enforcement powers and administrative penalty regime.
