Abstract
This Regulation consisting of 109 articles aims at (i) giving both citizens and the constructionists the tool to know the rules and procedures which they have to comply with to obtain the service they need; (ii) facilitating the achievement without violating the general laws and regulations enforced in the Sultanate; and (iii) facilitating for the citizens the procedures of building their residence or establishing projects, in cooperation with their regional Municipalities. It establishes that (i) public and private civil works need to obtain prior permission from the Municipality; (ii) applications for building or excavation permits shall be submitted to the Municipality; (iii) the major building permit shall be valid for two years, and the minor building permit shall be valid for one year from the date of issue, after which they must be renewed; (iv) health, environmental and technical regulations and conditions together with safety and security requirements for activities related to health, services, or factories shall be adhered to when preparing drawings;
Water provisions establish that (i) potable water tanks may be placed on the ground or on top of any building provided that health and technical conditions are adhered to (art.16); (ii) the construction of one or two water closets may be permitted on the condition that proper wastewater drainage is provided (art.50); (iii) all precautions against leakage of water through the walls and surfaces of the basement shall be considered and means for drainage from the basement shall be provided (art.50); (iv) articles 64 shows the minimum number of sanitary fittings in public buildings on the condition that a water tap shall be fitted in each bathroom; (v) every building shall be provided with necessary sanitary connections according to the specifications approved by the Sultanate and they shall be connected in such a manner that prevents any leakage (art.66); (v) channels for the discharge of surface water whether private or public shall be maintained, periodically repaired, and cleaned in order to protect public health and no solid refuse shall be deposited in them (art.68).
Waste provisions establish that (i) it is not permitted to transport building debris and remnants from one site to another prior to obtaining a permit from the Municipality (art.19); (ii) specifications for septic tanks, holding tanks, and soakaway pits are given at article 70; (iii) the contents of wastewater tanks shall be pumped periodically and discharged at site designated by the Municipality (art.73); (iv) the wastewater health and environmental conditions and specifications shall be considered and the municipality shall connect the wastewater pipes to the public sewer and collect the cost from the owner (art.74); (v) No trade, industrial, restaurants, workshops, car wash, etc. wastes shall be discharged into surface water or any public sewers prior to obtaining the approval of the Municipality (art.78).
Chapter I gives the General Provisions; Chapter II deals with Architectural and Technical conditions; Chapter III regards Buildings' drainage specifications; Chapter IV is on Building implementation control; Chapter V regards the Penalties.
