Abstract
This Regulation makes provision for the licensing of various fishery and fish breeding activities and the control of fisheries and regulates the export of fish. The following licences may be obtained under the Fisheries Management Act: a fishing vessel licence, a trail fishing licence, and aquaculture facility licence, a licence as a fish buyer, a licence as a fish storage facility or a fish factory, a fish export facility licence, or other licence as may be specified by the Minister, on recommendation of the Board. A fishing vessel licence shall be required for: a vessel which is used in the fisheries waters: (i) for commercial fishing, other than trial fishing; or (ii) for the commercial buying, storage or processing of fish; or (iii) as a mothership; or (iv) as a foreign registered fuel tanker supplying fuel to fishing vessels; or (v) as a reefer carrier receiving fish at the point of transshipment as provided in section 26 of the Act. Articles 3 to 7 provide more in detail for such licences, whereas articles 8 and 9 regulate licensing procedures. Articles 10 to 22 provide for various other matters regarding licences. Articles 23 to 27 regulate reporting, port calls and transshipment. Articles 28 to 31 define certain export requirements for fish. As for marking of vessels it is provided that the Managing Director shall approve requirements for the marking of vessels, consistent with the FAO Standard Specifications for the Marking of Identification of Fishing Vessels for the purposes of section 43(3)(c) of the Act (art. 34).
