Forestry (Amendment) Act 1993 (No. 1 of 1993).

This Act amends the Section 2 of the Principal Act by inserting the definition of customary owners, forest industry activities, forest industry participant and Managing Director of the National Forest Service; repealing the definitions of Director-General and forest operations; and amending the definitions of timber authority and timber permit. It also makes amendments: in Section 7 relating to the functions of the Authority; in Section 10 as regards the membership of the National Forest Board; in Section 11 on the appointment of alternate members; in Section 12 relating to the election of Chairman and Deputy Chairman of the Board; in Section 17 on the meetings of the Board; in Section 34 as regards the qualifications of the Managing Director of the National Forest Service; in Section 35 regarding the functions of the Managing Director; in Sections 50 and 51 about the national forest policy and development guidelines; in Section 55 on the types of land on which forest industry activities may be permitted; in Section 56 relating to the acquisition of timber rights from customary owners; in Section 57 about obtaining consent of customary owners to forest management agreement; in Section 60 on the rights under forest management agreement; in Section 62 about development options study; in Section 77 regarding the application for a timber permit; in Section 85 on the suspension of rights; in Section 86 as regards the conviction of the timber permit holder; in Section 91 on the licence to engage in forest industry activities; in Section 97 as regards the conviction of the licensee; in Sections 100, 101 and 102 on the project statement, five year working plan and annual logging plan submitted by the timber permit holder; in Section 122 on offences and penalties; in Section 122 as regards the powers of the Forest Inspector or Forest Officer to seize and sell timber or forest produce etc.; in Section 123 relating to unlawfull possession of forest produce; and further amendments in accordance with the Schedule.
