Abstract
This Regulation prescribes activities which are reserved for citizens and national enterprises. Regulation 3 lists the activities reserved for citizens including but not limited to: small-scale growing of crops and tree crops; small-scale processing and development of tree crops for export; small-scale livestock farming; poultry farming; hunting, trapping and game propagation including related service activities; gathering of wild growing forest materials; small-scale sawmilling; coastal and inland fisheries; taking of marine or freshwater crustaceans and molluscs; hunting of aquatic animals, such as turtles; hunting or collecting of non-protected wild fauna and their products; land surveying and valuing; mining and construction; recreational and cultural activities; recycling, such as of plastics; sea, road and air transportation; and consultancy services on insects, arts, culture, tourism, history and marine life.
Regulation 4 lists the activities reserved for national enterprises including but not limited to: fish hatcheries and fish farming; mining; and sea, road and air transportation. An enterprise shall only carry on business in a reserved activity under Section 27(5) and (6) of the Act, with a certificate. Form 3 in the Schedule sets out the application procedures for certification. Regulations 6, 6A and 6B lay down rules for fees, contents of register and amounts to be deposited by an individual, a partnership or a corporate body. A foreign enterprise may apply to the Authority for a certificate to carry on business in an activity under Section 29 of the Act.
Furthermore, this Regulation sets out provisions on the registration and cancellation of certificates; register of foreign investment opportunities; facilitation of new investments; certificate permitting a foreign enterprise to participate in a national enterprise; application under Section 36F of the Act for a variation of activity; and appeal to the Minister and appeal fees.
