Abstract
This Act provides with respect to prevention of and response to pollution by ships and declares the MARPOL Convention and the International Convention on the Control of Harmful Anti-fouling Systems on Ships 2001 to have the force of law in Papua New Guinea. The Act provides with respect to, among other things: prevention of ship-based pollution by oil, noxious liquid substances, harmful substances in packaged form, sewage, and anti-fouling systems; prevention of pollution from offshore installations; port waste reception facilities; inspections; and enforcement.
Provisions regarding oil pollution by ships give effect to the relevant provisions of Annex I of MARPOL. They apply to any vessel in Papua New Guinea waters and any Papua New Guinea vessel wherever it may be, except as otherwise provided. Regulations made under this Act may add to or delete from the list of Conventions to which the Act applies and shall have the force of law in Papua New Guinea, and any Convention added to the list may be implemented, enforced or otherwise applied in Papua New Guinea in accordance with this Act and any regulations made under this Act.
The Act also provides with respect to: International Oil Pollution Prevention Certificates; shipboard oil pollution emergency plans for oil; shipboard marine pollution emergency plans for noxious liquids; Anti-Fouling Systems Certificates and Anti-Fouling Systems Declarations; and garbage management plans. The National Maritime Safety Authority, established by the National Maritime Safety Authority Act 2003, has primary responsibility for the administration and enforcement of this Act.
