Abstract
This Act makes provision for the registration of National Land, i.e. any land declared under this Act to be National Land. The Act also makes provisions for certain matters in relation with the acquisition of land by the State for public purposes.
The Minister may declare, by Notice, a land to be National Land if the land, in the opinion of the Minister was acquired by a previous administration or required for a public purpose as defined by this Act or “a reason that is reasonably justified in a democratic society that has a proper regard for the rights and dignity of mankind”. No appeal can be made against a Notice except regarding compensation as provided for in the Act. National land shall be vested in the State, subject to any rights in or under it granted by the State or by a pre-Independence Administration in Papua New Guinea. National Land shall be registered in the Register of National Land established by this Act. The Act also provides for the establishment of a National Land Commission. The Commission shall decide on claims for settlement payments. Appeals shall be handled in accordance with procedures as set out in this Act.
