Abstract
Being an Act to amend the Public Health Act Cap 226.
This amends the principal Act Public Health Act by inserting a new section 1A on compliance with constitutional requirements; inserting a new section 11A after section 11 on exercise of powers; amendment of section 12 by repealing the penalty provisions and inserting, ‘ a fine not exceeding K5,000.00 or imprisonment for a term not exceeding 3 years, or both; amending section 16 on urgent reports of certain diseases; amending section 17, reports by medical practitioners and medical assistants; amendment of section 18 and 19 by repealing both the penalty provisions and replacing it with a fine not exceeding K10,000.00 respectively; amendment of section 20 and 21 by repealing the penalty provisions and replacing it with a fine not exceeding K1,000.00; amending section 22 and 26 by repealing the penalty provisions and replacing it with a fine not exceeding K10,000.00; section 28 is amended by repealing the penalty provisions and replacing with a fine not exceeding K10,000.00 or imprisonment for a term not exceeding 3 years, or both; section 29 to 31, repealing the penalty provisions for each sections and replacing it with a fine not exceeding K5,000.00 respectively; section 32 is amended in subsection 1 by repealing the penalty provision and replacing with a fine not exceeding K5,000 whilst subsection 2 is amended by repealing the penalty provisions and replacing it with a fine not exceeding K10,000 or imprisonment for a term not exceeding 3 years, or both; section 33 and 36, repealing the penalty provisions and replacing it with a fine not exceeding K1,000.00 respectively; section is amended in paragraph (a) by inserting the words ‘or any other infectious disease declared under section 15’, immediately after the words (including phthisis, bony tuberculosis, and military tuberculosis)’; section 47 is amended by repealing the penalty provisions and replacing it with a fine of K5,000.00; and section 141 is amended in paragraph (s) by repealing subparagraph (iii) and replacing it with, ‘of fines not exceeding K10,000.00 or imprisonment for a term not exceeding 3 years for offences against any other provision of the regulation’.
