Abstract
Being an Act to amend the Quarantine Act Cap 234;
The Act amends the principal Act Quarantine Act Cap 234 by inserting a new section 1A compliance with constitutional requirements. section 2 is amended by inserting a new definition of animal, aircraft, plant, quarantine, vehicle, vessel; section 3 is repealed and replaced with, ‘this Act binds the State; section 5(2) is amended by repealing the penalty provision and replacing it with a fine not exceeding K100, 000.00; section 10 is amended by repealing the words ‘Head of State acting on advice’, and replacing it with the word ‘Minister’. Inserting a new section 10A after section 10 on exercise of powers; section 16 is amended by repealing the penalty provisions and replacing it with a fine not exceeding K20,000.00; section 17(2), 18 and 25 the penalty provisions are repealed and replaced with a fine not exceeding K50,000.00; section 23 is amended by repealing the penalty provision and replacing it with a fine not exceeding K10,000.00; section 26, 27(2), 27(6) the penalty provisions are repealed and replaced with a fine not exceeding K50,000.00; section 26(5) the penalty provision is repealed and replaced with a fine not exceeding K10,000.00; section 29, 30 and 31 repealing the penalty provisions and replacing it with a fine not exceeding K1,000.00, 5,000.00 and 10,000.00 respectively; section 32(2), 37, 39, 41, 43, 44, 78 (1),79, 98 penalty provisions are repealed and replaced with a fine not exceeding K50,000.00 respectively; section
33-35(2), 36(1), 48, 51(1)(2), 52(1)(2), 53(3)(5)(6), 57-60, 80(1), 81, 84, 95(4) repealing the penalty provisions and replacing it with a fine of K10,000.00 respectively; section 92(2), 94(3)(4), 96(2) repealing the penalty provisions and replacing it with a fine not exceeding K1,000.00 respectively; and section 101 is amended by repealing paragraph (za) and replacing it with, (za) for prescribing penalties of fines not exceeding K100,000.00 for offences against the regulations’.
