Abstract
The objectives of this Act are to: (a) make it clear who is responsible for managing strata plans; and (b) help persons who manage, or help in the management of strata plans, understand and exercise their functions; and (c) assist in the resolution of disputes in relation to the management of strata plans; and (d) make the law about the management of strata plans easier to use generally.
This Act lays down provisions on the management of strata; establishment, functions, legal status and members of owners' corporation; authorization and functions of representatives; the installation and financing of sustainability or utility infrastructure on common property of the owners' company; right of owners' company of entry to units; consent of owners' company to keep animals within the unit or common property; the establishment, functions, powers and members of the Executive Committee; general financial functions and investments of the owners' corporation and the establishment of funds; insurance against risks, such as natural hazards; the establishment of corporate register; the strata title certificate and access to the records of an owners' corporation; dispute resolution; application of any interested party to the National Court for an administration order; and the functions of the administrator. Schedule 4 sets out the rules of an owners' corporation.
