Abstract
This Administrative Order of the Philippines establishes the revised implementing rules for the “People’s Small-Scale Mining Act of 1991”, setting out a comprehensive legal and institutional framework governing small-scale mining activities, including their authorization, regulation and supervision. It mandates that mining operations be conducted only within designated “Minahang Bayan” areas, subject to licensing, contractual arrangements and oversight by Provincial/City Mining Regulatory Boards, while defining procedures for area declaration, contract awards and mineral processing licensing. The regulation emphasizes environmental protection, community development and occupational safety by requiring environmental compliance certificates, management plans and waste control measures, including strict prohibitions on mercury use and unsafe practices. It also provides for revenue collection, state production share, and reporting obligations, alongside mechanisms for dispute resolution, enforcement, penalties and possible contract cancellation.
