Abstract
This Act is enacted to provide protection, preservation, conservation, sustainable and management to the wildlife, and establishment and management of protected areas in the Province of Balochistan. The Act consists of 96 Sections divided into 16 Chapters: I-Preliminary; II-Administration; III-Preliminary protection of wild animals; IV-Hunting of game animals; V-Possession and display of wild animals; VI-Wildlife trade and traffic; VII-Protected areas; VIII-Ex situ conservation; IX-Multilateral environmental agreements (MEAs); X- Community partecipation; XI-Powers of the government and officers; XII-Indemnity and removal of difficulty; XIII-Miscellaneous duties; XIV-Trial of offence cases; XV-Penalties and punishment; XVI-Repeals and savings.
The Government shall establish Balochistan Council for Conservation of Wildlife. The wild animals included in Schedule-III shall be protected. These wild animals shall not be hunted, killed, trapped, captured, traded, possessed or kept as pets except as provided specifically otherwise. The hunting, trapping and capturing of game animals in a Strict Nature Reserve, Wildlife Sanctuary, National Park, Natural Heritage Site and the core zone of a Biosphere Reserve are prohibited. A game animal may be hunted, with a valid license or permit subject to restrictions. Import and export of wild animals are subject to permits and other conditions under this Act. Government may further prohibit, or regulate the import, export, possession and trade, of wild fauna and flora, their parts, products and derivatives as contained in various appendices to Convention on International Trade in Endangered Species of Flora and Fauna (CITES) and Convention on Migratory Species of Wild Animals (CMS). The captive breeding and introduction of invasive and alien species of wild animals or propagation and introduction of invasive and alien species of wild plants as well as GMOs shall not be allowed.
The Act further makes provisions, inter alia, for: designation, planning and management of protected areas; community game reserves and forest biodiversity reserves; implementation of the Convention on Biological Diversity (CBD), The World Cultural and Natural Heritage Convention (WHC), UN Framework Convention on Climate Change (UNFCCC); participation of local communities; economic incentives and benefit sharing; offences and penalties.
