Abstract
This Act aims to provide for the protection, conservation, rehabilitation and improvement of the environment, for the prevention and control of pollution, and promotion of sustainable development in the Province of the Khyber Pakhtunkhwa. The Act consists of 40 Sections.
Section 3-7 and 21 provide for the establishment of the Khyber Pakhtunkhwa competent environmental protection authorities, the powers thereof and the establishment of Khyber Pakhtunkhwa environmental protection tribunals. There shall be established the Khyber Pakhtunkhwa Environmental Improvement Fund (Sec. 8) which provides financial assistance to the projects and activities of environmental protection and pollution control. No person shall discharge effluents, emissions or wastes in excess of load permitted in the conditions of environmental permit or environmental approval or license (Sect.11). The Government may ask to carry out strategic environmental assessment, of all or any of the plan or policy prescribed in Section 12, including: prevention of water pollution through improper sanitation and control flow of sanitation water into the rivers; and separate zones shall be specified for poultry and cattle farming and slaughtering houses; etc. The Act further makes provisions for: prohibition of import of hazardous waste; handling of hazardous substances; environmental impact assessment; offences and penalties; etc.
In addition, according to Section 31-32, the Government may make rules for carrying out the purposes of this Act, including rules for implementing the International Environmental Agreements specified in the SCHEDULE appended to this Act, such as the Plant Protection Convention, Convention on Biological Diversity, United Nations Framework Convention on Climate Change and Convention on International Trade in Endangered Species of Wild Fauna and Flora. The Government may amend the SCHEDULE.
