Decree-Law No. 108/2018 establishing the legal regime for radiological protection, transposing Directive 2013/59/Euratom.

This Decree-Law establishes the legal regime for radiological protection, as well as the attributions of the competent authority and inspection authority for radiological protection, transposing Council Directive 2013/59/Euratom, of 5 December 2013, which sets basic safety standards for protection against dangers resulting from exposure to ionizing radiation. It transfers the mission, attributions and powers of the Regulatory Commission for the Safety of Nuclear Installations (COMRSIN) to the competent authority, transposing into the internal legal order the rules relating to the competent authority of Council Directive 2009/71/Euratom of 25 June 2009, as amended by Council Directives 2014/87/Euratom of 8 July 2014, and Council Directive 2011/70/Euratom, of 19 July, proceeding to the dissolution of COMRSIN. The competent authority takes over the attributions and competences of the national authorities that have attributions and competences, within the scope of radiological protection.
The Decree-Law is applicable to all practices involving the use of ionizing radiation and equally applicable to occupational exposure, public exposure and medical exposure to ionizing radiation, provided that they cannot be ignored from the point of view of radiation protection and constitute situations of planned, existing or of emergency. In particular it applies: a) manufacture, production, treatment, handling, disposal, use, storage, holding, transport, import and export of radioactive material; b) manufacture and operation of electrical equipment, which emit ionizing radiation; c) Human activities involving the presence of natural radiation sources leading to a significant increase in the exposure of workers or members of the population, in particular: i) operation of aircraft and space vehicles with regard to the exposure of crews; ii) The processing of materials containing natural radionuclides; d) Exposure of workers or members of the public to radon inside buildings, exposure to external radiation from building materials and continued exposure from an emergency situation or previous human activity; e) Preparation, response planning, and management of emergency exposure situations, which justify the application of measures to protect the health of members of the public or workers.
