This Decree-Law regulates land, road and rail transport of dangerous goods, transposing the Commission's Directive No. 2006/90/EC of 3 November and the Directive No. 2008/68/EC of the European Parliament and of the Council of 24 September. It applies to operations involving the transport of dangerous goods, including loading and unloading operations, transfers from one mode of transport to another and stops required by the conditions of transport, carried out on roads in the public domain, as well as on any other roads open to public transit. It excludes operations carried out only within the perimeter of one or more companies without the use of roads open to public transit. Provisions contained in Annex I apply to the transport of dangerous goods by road; provisions contained in Annex II apply to the transport of dangerous goods by rail; The specific safety requirements for national and international transport operations of dangerous goods carried out in the national territory are defined by regulatory decree, with respect to: a) transport of dangerous goods by vehicles or wagons not covered by this decree-law, in accordance with the definitions contained in paragraphs e) and f) of article 2; b) The possible use of prescribed routes, including the use of prescribed modes of transport; c) Special rules for the transport of dangerous goods on passenger trains.
