Decree-Law No. 50/2019 ensuring the implementation in the national legislation of Regulation (EU) 2016/1628 laying down the requirements for emission limits for gas and particulate pollutants as well as for the approval of internal combustion engines for non-road mobile machinery.

This Decree-Law, consisting of 17 articles divided into five Chapters, aims at regulating the gas emission, the particulate pollutants limits, and the approval of internal combustion engines for non-road mobile machinery. This Decree-Law shall ensure the implementation in the national legislation of EU Regulation No. 2016/1628 of the European Parliament and the Council of 14 September, laying down the requirements for emission limits for gases and particulates pollutants and the approval of internal combustion engines for non-road mobile machinery. It amends EU Regulations No. 1024/2012 of the European Parliament and the EU Council of 25 October No. 167/2013 of the European Parliament and the Council of 5 February, repealing Directive 97/68/EC of the European Parliament and of the Council of 16 December. This Decree-Law establishes the following provisions: a) appoint the national authorities competent for the implementation of the Regulation; b) establish procedures for reporting to the European Commission and other Member States; c) establish the obligations of the approval authority and the market surveillance authority under the Regulation; d) creates the sanctioning framework applicable in case of violation of provisions of the Regulation and this Decree-Law.
