Abstract
This Decree-Law, consisting of 35 articles divided into seven Chapters and 14 Annexes, lays down the rules applicable to the composition, labelling, information to consumers and the marketing of milk, milk products and products extracted from milk. This Decree-law transposes Directive 2015/2203 of the European Parliament and the Council of 25 November 2015 on the approximation of the legislation of the Member States relating to casein and caseinates intended for human consumption. In addition, it lays down additional national rules on the provision of information on the origin of milk and milk used as an ingredient in dairy products, ensuring the compliance with Regulation (EU) No. 1169/2011 of the European Parliament and the Council of 25 October 2011 on the information to consumers of foodstuffs. This Decree-law also consolidates, in national legislation, the transposition of the following directives: Commission Directive 2006/141/EC of 22 December 2006, as amended by Commission Directive No 2013/46/EU of 28 August 2013 on infant formulas and Transitional formulas for protein requirements in infant formulas and follow-on formulas; Council Directive 2001/114 / EC of 20 December 2001, as amended by Council Directive 2007/61/EC of 26 September 2007.
The Decree-Law is divided as follows: Object, scope and definitions (Chap. I); Conditions applying to the indication of the origin of milk and milk used as an ingredient in milk products (Chap. II); Regime applicable to the identification of caseins and caseinates or products containing caseins and caseinates (Chap. III); Arrangements for the composition, labelling, advertising and marketing of infant formulas and follow-on formulas (Chap. IV); Regime for the designation and labelling of certain partly or wholly dehydrated preserved milk (Chap. V); Sanctioning regime (Chap. VI); Complementary, transitional and final provisions (Chap. VII).
