Order No. 395/2015 establishing technical requirements to be satisfied by Environmental Impact Assessment procedures.

This Order, consisting of 10 articles and six Annexes, specifies the formal technical requirements to be met by the following procedures (set out in paragraph 2 of art. 3, paragraph 2 of art. 4, paragraph 2 of art. 12, the paragraph 3 of art. 18 and art. 26 of the legal framework of Environmental Impact Assessment (EIA), approved by Decree-Law No. 151-B/2013 of 31 October, as amended by Decree-Law No. 47/2014, of March 24, and Decree-Law No. 179/2015 of 27 August): a) Prior assessment and decision subject to EIA; b) Authorisation of the EIA procedure; c) Proposal for scoping; d) Environmental Impact Assessment Model; and e) Post-evaluation. Annexes list the following issues: Elements for prior review and submission of the decision to the Environmental Impact Assessment; Exemption from application of the Environmental Impact Assessment procedure; Proposal for defining the scope of environmental impact assessment; Model of Environmental Impact Assessment; Monitoring report and other documents associated with the post-evaluation.
