Abstract
This Act consolidates and establishes the official Penal Code of the Republic of Palau, designated as Title 17 of the Palau National Code. The primary purpose of this Code is to forbid and prevent conduct that unjustifiably and inexcusably inflicts or threatens substantial harm to individual or public interests. It aims to subject to public control persons whose conduct indicates they are disposed to commit offenses, to give fair warning of the nature of the conduct prohibited, to distinguish on reasonable grounds between serious and minor offenses, and to prescribe proportionate penalties that provide just punishment, rehabilitation, and deterrence against future criminal violations within the penal jurisdiction of the Republic.
The Code is structured into general principles of penal liability and specific classes of statutory offenses. It defines the general requirements for voluntary acts, omissions, and states of culpability, while establishing the standard of proof beyond a reasonable doubt for criminal convictions. Key provisions define offenses against persons, property rights, and public administration. Notable statutory offenses include theft, criminal property damage, fraud, forgery, bribery, and misconduct in public office. The text outlines the grades and classes of offenses—categorizing them into felonies and misdemeanors—and prescribes corresponding penalties, including terms of imprisonment, monetary fines, and probation standards. Additionally, the final provisions include specific regulations and enforcement measures governing public order, public health safety, and the restriction of unauthorized gaming and siber lottery activities within the territory.
