Abstract
This Law, consisting of 29 articles, establishes structure, composition and functioning of the Ministry of the Environment. Article 1 divides the various administrative units according to the official responsible, as follows: administrative units of the Minister (a total of 7, analyzed in more detail in arts. 2-7); administrative units of the Undersecretary (3, analyzed in arts. 8 and 9); administrative units of the Assistant Deputy Minister for Environmental Affairs: (8, analyzed in arts. 10-16); administrative units of the Assistant Deputy Minister for Agriculture and Fisheries (5, analyzed in arts. 17–20); administrative units of the Assistant Undersecretary for Joint Services (5, analyzed in arts. 21–24).
The Minister is mostly responsible for organizational, planning and legal issues, foreign relationships and international cooperation. He also deals with natural reserves and quality control.
The Undersecretary handles the emergencies and is concerned with awareness and environmental education among the people.
The Assistant Deputy Minister for Environmental Affairs is responsible for environmental assessment and permits for installations, projects and activities of environmental impact. Environmental monitoring, prevention of radiation and chemicals, environmental protection, wildlife, industrial inspection and control of pollution and climate change issues are also under his liability.
The Assistant Deputy Minister for Agriculture and Fisheries is in charge for management of agriculture, animal husbandry, fishery and groundwater activities, the issuance of increased space and acquisition of farm land permits, the implementation of rented farms contracts with the State, the veterinary instructions. He is also responsible for the general plan for the protection, development, manufacture and proper exploitation of fisheries, the programs for sustainable development of the fish stocks, experimental fish farms and licensing of fishing vessels, fishermen and means of fisheries and aquaculture, and the other activities associated to the aquatic wealth.
The Assistant Undersecretary for Joint Services is concerned with human resources, finance and administration, management of public services and information systems.
