Abstract
This Law, consisting of 5 articles, modifies the original Law of 2017 as follows: (i) Article 4 prohibits occupying public spaces and coastal areas with abandoned items without a permit, allows the municipality to seize and auction unclaimed items after three months to cover expenses, and provides the right to appeal to the minister; (ii) Article 8 prohibits leaving, dumping, or disposing of waste outside designated areas, and allows the municipality to remove violations at the offender's expense and impound transport vehicles used in these violations for up to three months; (iii) Article 10 establishes that the competent municipality is responsible for all aspects of public cleanliness, including waste collection, transport, disposal, and recycling, and may delegate these tasks to contractors, with service fees and exemptions determined by the minister, while building managers and business owners can also handle these tasks via contractors in exchange for service fee exemptions, with contractors being accountable for their waste collectors and disposal methods; (iv) Article 15 concerns sanctions. The amendment adds Article 9 bis, establishing the Joint Committee for the Removal and Disposal of Abandoned Vehicles, Machinery, and Equipment within the Ministry. Lastly, the annexed Table is amended to indicate the amounts to be paid for reconciliation concerning different types of violations.
