Abstract
Purpose of this Law is to regulate the navigation in Qatar. This Law is composed of 5 Section divided into 293 articles: The Ship (I); Persons of the Ship (II); Ship Exploitation (III); Maritime Accidents (IV); and Maritime Insurance (V).
Section I contains provisions relating to nationality of the ship, rights of ownership and undivided co-ownership, concession rights, maritime mortgage, seizure of the ship and ship of the State. Section II provides for investor and owner of vessel, captain, and maritime labour contracts (in particular: art. 97 deals with duty of seafarer to obey instructions of superior, and to save persons and cargo aboard the vessel in case of danger; arts. 99-102 provide for payment of salaries to seafarers; arts. 104-105 make provision for health care for seafarers as well as for occupational injuries and diseases; art. 106 establishes obligation of investor to assume burial costs if seafarer dies while on duty and art. 107 regulates duty of investor to ensure seafarer's return to shore). Section III regulates leases of equipped and unequipped ships, maritime transport contracts (bills of lading, transport of hazardous, inflammable or explosive materials, rules of liability), persons transportation (travel tickets, liability of carrier and liability of traveler), towing and pilotage. Maritime accidents are the subject of Section IV, divided in Collision, Assistance and Salvation (applicable to maritime ships – except for military ships or state's ships allocated to non-commercial purposes - that are in danger, the persons on board and the objects transported, together with the captain obligations), and General Marine Losses, given in detail in art. 210. Section V regulates Maritime Contracts, in particular Insurance Contracts, Damage Settlements and Prescription. This first part deals with obligations and responsibilities of the insurer and the insured, while the second part of Section V is dedicated to particular cases of insurance, which are: Insurance of the Ship, Insurance of the Goods and Insurance from Liability.
