Agreement between the Government of Romania and the Cabinet of Ministers of Ukraine regarding the implementation of the Convention on environmental impact assessment in a transboundary context.

The purpose of this Agreement is to promote and further develop the implementation of the Convention between parties, to facilitate environmental impact assessments carried out on the territories of the states in accordance with the Convention and to further develop cooperation between the competent authorities of the Parties in the field of environmental protection. The Parties encourage regular, direct and good communication between their officials, in order to solve expeditiously all aspects related to the environmental impact assessment procedures. The Parties shall facilitate public access to the information and documents exchanged in accordance with this Agreement, including by making such information and documents available to the public on the official websites of their competent authorities without delay and easily searchable and identifiable. Regarding the location criterion, the parties pay particular attention to the Carpathian region, as well as to common transboundary river basins, including the Danube Delta. Upon receipt of the environmental impact assessment documentation, the affected Party expresses, without delay, the willingness to start consultations. The consultations shall refer to: (a) possible alternatives to the proposed activity, including the alternative of abandoning the activity and possible measures to mitigate the significant negative cross-border impact and monitoring the effects of these measures, including the financing of such monitoring and other relevant arrangements; (b) other possible forms of mutual assistance in order to reduce any significant negative cross-border impact of the proposed activity; and (c) any other pertinent aspects related to the proposed activity.
