Convention concerning Fishing in the Waters of the Danube, 1958.

The Convention outlines general principles governing fishing activities in that part of the Danube forming part of the territory of the member states and provides for the creation of a Mixed Commission to implement the Convention. The Annex contains more specific regulations on fishing: Prohibited places and times (Part I); Prohibited tackle and fishing methods (II); Mesh size (III); Size of fish, crayfish and molluscs (IV); General provisions (V).
The scope of the Convention is defined in article 3. It applies to the waters of the Danube, including its mouth, to tributaries up to the maximum extent of its flood waters, and to lakes, estuaries and pools permanently or temporarily connected with the Danube. Article 5 stipulates that those Contracting States which construct dams shall prepare and jointly implement a plan of action to safeguard the normal migratory movements of fish. Piscicultural operations shall be developed in order to increase the stocks of economically valuable species (art. 6). Joint measures shall be worked out so as to prevent the contamination and pollution of the river (art.7). Contracting States have a duty of cooperation in communicating information on catches and migratory movements of fish (art. 8), in strengthening scientific and technical collaboration (art. 9). A Mixed Commission with the task of working out and coordinating measures for the application of the Convention, shall be established (art. 11). Its duties are set out in article 12 and include the devising of measures for the regulation of fishing and increasing fish stock as well as the organization of information exchange between Contracting Parties (art. 12). The Mixed Commission has the power to make recommendations on the matters within its competence (art. 13). This Convention is open to accession by Danubian States (art. 14) and does not preclude the conclusion of bilateral agreements on matters relating to fishing in the Danube between two Contracting Parties or a Contracting Party and any other Danubian State (art. 15). Article 16 stipulates that the Convention shall enter into force on the date of the deposit of the last instrument of ratification. The Convention is valid for five years and shall remain in force for another five years, unless a Party gives notice of termination within six months of its expiry (art. 17).
